Terms of Use

Welcome to Crosscut. These Terms of Use ("Terms") are a binding agreement between you and the developer of Crosscut ("we," "us," or "the developer") governing your use of the Crosscut iOS application ("the App"). By downloading or using the App you agree to these Terms. If you do not agree, do not use the App.

1. License

We grant you a personal, non-exclusive, non-transferable, revocable license to use the App on Apple-branded devices that you own or control, as permitted by the Apple App Store Terms of Service. You may not copy, modify, distribute, sell, lease, reverse-engineer, or create derivative works of the App except as permitted by law.

2. Your content

Everything you record with Crosscut is yours. The App processes and stores your video and audio entirely on your device. We claim no ownership of, and take no license to, your recordings. Because recordings never leave your device through us, you are solely responsible for storing and backing them up; deleting the App deletes any takes still stored inside it.

3. Recording responsibly

You are solely responsible for how you use the camera and microphone. Laws about recording people, audio, performances, and private property vary by location and may require consent from the people you record. You agree to obtain all necessary consents and to comply with all applicable laws when recording. We are not responsible for any recording you make.

4. No warranty

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the App will be uninterrupted or error-free, that recordings will always be captured, saved, or synchronized correctly, or that files produced by the App will be compatible with any third-party software. Do not rely on the App as the sole recording of any event that matters to you; test your setup before important shoots.

5. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE DEVELOPER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, LOST RECORDINGS, LOST PROFITS, OR LOSS OF GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE APP, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE APP SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE APP IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE OR (B) FIFTY U.S. DOLLARS (US $50). Some jurisdictions do not allow certain exclusions or limitations, so some of the above may not apply to you.

6. Indemnity

You agree to indemnify and hold the developer harmless from claims arising out of recordings you make, your violation of these Terms, or your violation of any law or the rights of a third party.

7. Device permissions

The App requests access to the camera, microphone, and (optionally, for saving) your photo library. These permissions are used only to provide the App's recording and export features. You can revoke them at any time in iOS Settings; core features will stop working without them.

8. Thermal and hardware limits

Sustained multi-camera recording is demanding. The App manages heat by reducing frame rate, suspending streams, or stopping recordings safely. You accept that recording may be interrupted by the device's thermal, storage, or power limits.

9. Apple-specific terms

These Terms are between you and the developer only — not with Apple Inc. ("Apple"). Apple has no obligation to furnish maintenance or support for the App and is not responsible for addressing any claims relating to the App, including product liability, legal compliance, or intellectual-property claims. In the event of any failure of the App to conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any); to the maximum extent permitted by law Apple has no other warranty obligation. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You represent that you are not located in a country subject to a U.S. Government embargo and are not on any U.S. Government restricted-parties list.

10. Changes and termination

We may update the App and these Terms; material changes will be reflected by an updated effective date. We may terminate this license if you breach these Terms. Sections 2–6 survive termination.

11. Governing law

These Terms are governed by the laws of the United States and the State of California, without regard to conflict-of-law rules.
